Breach of borrowing limits
โ134. Breach of borrowing limits If a GTE borrows an amount that exceeds the borrowing limit set for the GTE under section 133, the GTE commits an offence. Penalty for this section: a fine of $12 000.โ
Providing false or misleading information
โ49. False or misleading information An executive officer or a member of the staff of a GTE must not give information to a director, the CEO, the Portfolio Minister or the Treasurer that the executive officer or member of staff knows is false or misleading in a material particular. Penalty for this section: a fine of $36 000 or imprisonment for 1 year, or both.โ
Improper use of position
โ50. Use of position (1) An executive officer or a member of the staff of a GTE must not make improper use of the position of executive officer or member of staff to gain, directly or indirectly, an advantage for himself or herself or any other person or to cause detriment to the GTE. Penalty for this subsection: a fine of $72 000 or imprisonment for 2 years, or both. (2) In this section: improper use of position means use of the position in a way that contravenes section 47 or 48.โ
Improper use of information
โ51. Use of information (1) An executive officer or a member of the staff of a GTE must not make improper use of information acquired by virtue of the position of executive officer or member of staff to gain, directly or indirectly, an advantage for himself or herself or any other person or to cause detriment to the GTE. Penalty for this subsection: a fine of $72 000 or imprisonment for 2 years, or both. (2) In this section: improper use of information means use of the information in a way that contravenes section 47 or 48.โ
Failure to comply with information request
โ89. Duty to comply with information request If a GTE receives a request under section 88, the GTE must comply with the request. Penalty for this section: a fine of $12 000.โ
