The Delegated Legislation Committee found that the Shire of Northam failed to substantially comply with the Local Government Act 1995 (LGA) when making the Cemeteries Amendment Local Law 2017. The Shire gazetted and notified a different version of the local law than the one adopted by the Council, breaching mandatory procedures. The Committee recommended disallowance of the gazetted local law due to invalidity.

The public is affected due to the risk of misinformation from an invalid local law. The Shire of Northam needs to remake the local law correctly.
