I refer to the recently announced Commercial Lease of Jorgensen Park in the City of Kalamunda:(a) Will the Minister advise whether a 15-week, nightly commercial event constitutes a “temporary event” for the purposes of the Environmental Protection (Noise) Regulations 1997, or whether it should be assessed as a recurring venue under Regulation 19B;(b) If yes to (a), will the Minister confirm whether the proposed event at Jorgensen Park has been, or is required to be, assessed under Regulation 19B, which includes mandatory community consultation requirements;(c) If the event is assessed under Regulation 18, will the Minister advise how a 15-week recurring nightly event meets the intent of a one-off event approval pathway;(d) Will the Minister confirm whether any Regulation 18 application was lodged at least 60 days prior to the proposed commencement date, as required under the Regulations; and(e) Will the Minister advise whether residents within proximity to Jorgensen Park are entitled to consultation and appeal rights in relation to noise approvals for this event?

(a)    The Environmental Protection (Noise) Regulations 1997 (Noise Regulations) do not include the term ‘temporary event’. Regulation 19B allows for the approval of a venue to host one or more events over a period specified in the approval.
(b)    The City of Kalamunda (City) is the responsible regulatory authority in relation to noise emissions from events held at Jorgensen Park.  Local government officers have delegated authority in relation to provisions under the Noise Regulations including the authority to determine applications made under regulations 18 and 19B. I am advised officers from the Department of Water and Environmental Regulation have discussed with the City of Kalamunda (City) the upcoming Harry Potter: A Forbidden Forest Experience event, which I assume is the event to which you are referring.  It is understood that acoustic modelling for the event indicates the noise emissions will comply with the prescribed standards under the Noise Regulations, so no approval under regulation 18 or 19B is required.

(d)    No regulation 18 application has been lodged.
