Transgender prisoners42.Hon Philip Scottto theminister representing the Minister for Corrective Services:I refer to the revelation that Bandyup Women's Prison is housing a biological man accused of domestic violence against his female partner.(1) Can the minister confirm whether the government's amendments to the Births, Deaths and Marriage Registration Act has resulted in a biological man being housed in a women's prison?(2) It has been reported that:the accused was segregated from the general prison population because a person with a penis housed in an all-female environment was considered too disruptive.Why was the accused considered too disruptive to be in an all-female environment?(3) In answers provided to my question without notice on 15 October last year, the minister stated the Department of Justice considers the placement of all prisoners in accordance with departmental policies and procedures. Is the department currently considering a separate prison facility to house transgender inmates and, if so, why the change of policy?The President:That seems like a very long question to me, honourable member, but we will see if the minister has an answer.

The department advises the following.(1) No. The amendments to the Births, Deaths and Marriages Registration Act do not determine prisoner's placement.(2) The department does not comment on the accuracy of media reports regarding individual prisoners.(3) No. Transgender prisoners
