These regulations specify offences that the District Court of Western Australia does not have jurisdiction to try, relating to indictable offences with a maximum penalty of life imprisonment and concerning matters such as homicide, genocide, armed conflict, terrorism, and piracy. Certain crimes under The Criminal Code sections 392, 393 or 444 are excluded from this exclusion.
Accused persons charged with specific serious indictable offences (e.g., homicide, terrorism) will not have their cases heard in the District Court. This affects the allocation of cases within the court system and potentially the speed and type of trial process.
